The DMCA
The Digital Millennium Copyright Act (“DMCA”) establishes a formal process for copyright owners (including content creators and software developers) to request Entrepreneurship Hacks LLC to remove infringing content. Accurate Information
Under the DMCA, you are required to swear to the truthfulness of your infringement notice under penalty of perjury. It is a federal offense to knowingly provide false information in a sworn declaration (refer to U.S. Code, Title 18, Section 1621). Submitting false information could also lead to civil liability, meaning you could be sued for damages.
Investigate
Countless users and organizations invest significant effort into creating content. Filing a DMCA infringement notice is a serious legal claim with real consequences. Therefore, we request that you conduct a thorough investigation and consult with an attorney to ensure the content usage is not actually permitted under law before submitting a takedown request.
A good initial step before sending a takedown notice is to attempt direct contact with the content creator.
No Automated Bots
Each takedown notice should be evaluated by a trained professional based on the specific facts. If you're delegating this task to a third party, ensure they are not using automated systems to file notices in bulk, as these are frequently invalid and lead to unnecessary content removal.
Counter Notices
Users affected by your takedown notice may submit a counter notice. If received, we will restore their content within 14 days unless you inform us that you have started legal proceedings to prevent the user from engaging in infringing activity related to the content on our platform.
The Determination
Entrepreneurship Hacks LLC exercises minimal discretion in this process, other than verifying if notices comply with the DMCA's minimum requirements. It is the responsibility of the involved parties (and their legal representatives) to assess the validity of their claims, remembering that notices must be submitted under penalty of perjury.
DMCA Takedown Notice
To report unauthorized use of your copyrighted content on our platform, please send an email notification to hello@entrepreneurshiphacks.com. Although attachments are accepted, including a plain-text version of your notice in the email body is preferable. The notice should include:
1. A physical or electronic signature (typing your full name is acceptable) of the copyright owner or a person authorized to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed (e.g., a link to your original work or a clear description of the materials allegedly infringed upon);
3. Identification of the infringing material and information reasonably sufficient to allow us to locate the material on our services;
4. Your contact information, including your address, telephone number, and an email address;
5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notice is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

DMCA Counter Notice
If you believe your content on our platform was mistakenly removed due to a DMCA takedown request, you have the right to file a counter notice. Before doing so, please ensure you meet the requirements for DMCA counter notifications.
